Article 1: General Provisions

The electronic webshop of De Mobiele Slijperij, hereinafter referred to as “demobieleslijperij.be”, with registered office in Stekene, VAT BE1005702829, Tel. +32 484 68 10 19, offers its customers the possibility to purchase products online.

These general terms and conditions apply to all items from the demobieleslijperij.beassortment and to every purchase made by the customer via www.demobieleslijperij.be.

The customer accepts that these conditions are the only applicable terms, excluding their own general or specific (purchase) conditions, even if such conditions state that they alone apply.

Article 2: Price

All prices listed are always inclusive of VAT and all other taxesthat the customer is obliged to pay.

If transport, reservation, or administrative costsare charged, this will be stated separately.

The stated price relates exclusively to the items as described verbally. The accompanying photo is intended for decorative purposes and may contain elements not included in the price.

All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of such errors.

Article 3: Offer

Each offer is only open to customers residing within the European Union.

Although the catalogue and website are compiled with the greatest possible care, it is possible that the information provided is incomplete, contains material errors, or is not up to date. Colours may slightly differ from the colours shown in the photos.

The offer is valid while stocks lastand may be modified or withdrawn at any time.

Demobieleslijperij.be reserves the right, without giving reasons, to refuse orders, adjust delivery times, split deliveries, or attach other conditions to the delivery.

Article 4: Purchases

The customer has the possibility to purchase items from the Demobieleslijperij.berange online.

The purchase agreement is concluded at the moment the customer receives a confirmation email from Demobieleslijperij.becontaining an order number and the total amount due.

Items are delivered to the customer’s home or can be collected if desired.

We attach great importance to the security and reliability of the ordering and payment process. You can therefore assume that all payments will be processed securely and reliably.

The customer can choose between the following payment methods:

• Credit card: VISA, Mastercard

• Bank card: Bancontact

• Bank transferto our account. As soon as we receive the total amount, we will ship your order the same day. If payment has not been received within 7 days, the order will automatically be cancelled. Always use the order numberwhen making the payment so that we can process it quickly.

• Payment upon collection: cash or via Bancontact, VISA, Mastercard.

Article 5: Retention of Title

The delivered items remain the exclusive property of Demobieleslijperij.be until full payment has been received.

The customer undertakes to inform third parties of this retention of title if necessary, for example anyone who might attempt to seize items that have not yet been fully paid.

Article 6: Penalties for Non-Payment

Without prejudice to other rights available to Demobieleslijperij.be, the customer will, in the event of non-payment or late payment, automatically owe interest of 10% per yearon the unpaid amount from the date of default and without prior notice.

In addition, the customer will owe a fixed compensation of 10%of the outstanding amount, with a minimum of €25 per invoice.

Without prejudice to the foregoing, Demobieleslijperij.be reserves the right to reclaim unpaid items.

Article 7: Complaints

Any visible damage and/or qualitative defectof an item or any other shortcoming in delivery must be reported immediately, failing which all rights will lapse.

Article 8: WarrantyLegal Warranty (Consumers Only)

In accordance with the law of 21 December 2004 concerning consumer protection in the sale of consumer goods, consumers have legal rights.

Each item is subject to the statutory warranty from the date of purchaseby the first owner.

General

To invoke the warranty, the customer must present proof of purchase.

For items purchased online and delivered to the customer’s home, the customer must first contact Demobieleslijperij.be, after which the customer must return the item at their own expense.

Any defect must be reported within 1 month after it has been detected. After this period, any right to repair or replacement expires.

The warranty does not applyto defects resulting from:

• accidents

• negligence

• drops

• abnormal or incorrect use

• use contrary to the intended purpose

• failure to follow instructions or manuals

• incorrect washing

• modifications to the product

• rough handling

• poor maintenance

• normal wear and tear

Defects that appear more than 6 months after purchaseare presumed not to be hidden defects, unless proven otherwise by the customer.

The warranty is not transferable.

Article 9: Right of Withdrawal

The provisions of this article apply only to customers acting as consumerswho purchase items online.

The consumer has the right to inform Demobieleslijperij.be that they withdraw from the purchase without penalty and without giving any reason within 14 daysfrom the day following delivery of the product.

Customers who wish to exercise the right of withdrawal must contact Demobieleslijperij.be within 14 days after deliveryand return the goods within 20 days after deliveryat their own expense to:

Goods with a sales price of €100 or more must be returned by courier(DHL, FedEx, etc.).

Only items returned in the original and undamaged packaging, including all accessories, instructions, and invoice or proof of purchase, can be accepted.

The following items will not be accepted for return:

• used, dirty, damaged, or incomplete items

• items whose packaging has been opened

• custom-made items

• items that cannot be returned due to their nature

Article 10: Validity – Non-Waiver

If any provision of these terms is declared invalid, illegal, or void, this shall not affect the validity, legality, or enforceability of the remaining provisions.

Failure by Demobieleslijperij.be to enforce any right listed in these terms shall never be considered a waiver of that right.

Article 12: Changes to the Conditions

These terms may be supplemented by other conditions explicitly referred to and by the general sales conditions of Demobieleslijperij.be.

In the event of conflict, these conditions prevail.

Demobieleslijperij.be may modify these terms at any time without prior notice. Any purchase after modification implies acceptance of the new terms.

Article 13: Evidence

The customer accepts that electronic communications and backups may serve as evidence.

Article 14: Applicable Law – Competent Court

Belgian law applies.

In the event of disputes, only the courts of Ghent (Gent)have jurisdiction.
